Acceptance
By registering for, or using any of our services you agree that you have read, understand and are bound by these terms.
Should there be a written contract signed with us, you will also be bound by these terms. In cases where there are conflict between the written contract and these terms, the written contract will prevail.
Changes to terms
The terms herein (without limitation) may change at any time without prior notice to you.
Warranties
You acknowledge and agree that your usage of Imagine Global Websms services and other services is at your sole risk without any warranties. Imagine Global, including its Directors, Employees and Partners, to the maximum extent permitted by law, disclaims any and all representations and warranties, whether express or implied including, but not limited to the accuracy of information, or the quality, performance, non-infringement, merchantability or fitness for used for a particular purpose, nor any warranty an so the results that may be obtained by using the services. You should not use the services to knowingly transfer SMS messages that are classified as SPAM under applicable law. In the event that a destination operator for an SMS message complaints to Imagine Global that it’s network has been used to originate SPAM, Imagine Global shall suspend the account immediately.
Services
Our services are provided based on our best effort and our best ability. Imagine Global does not guarantee the total liability in message routing, storing and delivery, which can be subject to interruptions in the service of network operators due, and not limited to, radio interference, the unavailability of targeted recipients, third party maintenance and circumstances beyond the control the Imagine Global.
We may suspend, interrupt, change or end any service for what so ever reason without prior notice. Advance notice of any planned service interruption due to maintenance of Websms will be notified via email.
Account, password and security
In order to register for, or use a service, please provide us with your accurate information. You warrant that all information you give is current, complete and accurate. We may suspend or stop any service if you give information that is incomplete and inaccurate. Any changes to these information must be notified from time to time. You are allowed to select your own username and password.
Delivery
Imagine Global shall not be liable for faults in delivery, transmission, retransmission or reception of the SMS messages attributed to the carrier of third parties.
Messages are deemed to have been delivered when we have delivered or sent the messages to the immediate destination that our software is programmed for, including SMTP servers, mobile telephone networks, or any other intermediary server or API that is deemed to be the point of dispatch of the message.
Your privacy
All personal information or account details are private & confidential. However, should we receive a formal complaint from a mobile network operator / third party that is directly related to your Imagine Global account, then we are obliged do so by law.
We shall not be liable for any unauthorised or unlawful disclosures of your personal information by third parties who are not subject to our control (for example, advertisers and websites that have links to the Imagine Global website).
Waivers
Imagine Global failure to enforce any right or provision under this Condition does not constitute a waiver of such right or provision or of any other right or provision in this condition.
Modification of Terms
Imagine Global may, at its sole discretion, amend, modify, add, remove or altogether change the terms and conditions of this Condition. Imagine Global shall notify you upon login of any changes. Upon log in your User Account, you are deemed to have agreed to the updated terms.
Charges and payment
In consideration for using our services, our prepaid charges are as per the price list which will be updated from time to time. These charges are to be paid excluding bank charges, taxes or any other finance charges imposed. Please note that our charges are based on submission of the SMS messages.
Unused sms balance are non-expiry and non-refundable.
